This document contains the Terms and Conditions of the contract for the use of the services provided by KNSB via the website “https://fond-knsb.com/en/”

These terms constitute an AGREEMENT between you and KNSB, in its capacity as the owner of the website, by which you are granted the right to use it on all types of devices for personal and non-commercial purposes, subject to the conditions below.

By using the website “https://fond-knsb.com/en/”, each of its menus, sections and subsections, categories, or subcategories, you provide your consent to be bound by the present conditions of use of the site, as well as all other conditions regulating separate legal relationships conditioned by its use.

The binding of the conditions is applicable both to the current configuration of the site and to all changes made to it in the form of additions or amendments or introduction of new menus, categories, sections, functionalities, and others. KNSB reserves the right to unilaterally change the conditions for the use of the website and the services provided through it unilaterally at any time, and the changes will be published on the site immediately after their acceptance and entry into force.

For the purposes of these Terms and Conditions, the listed concepts are used with the following meaning:

2.1. CONFEDERATION OF INDEPENDENT TRADE UNIONS IN BULGARIA (KNSB), with BULSTAT 00070327, with headquarters and management address: Sofia, p.k. 1040, “Macedonia” Square No. 1, is a legal entity entered in the register of trade union and employer organizations at the Sofia City Court.
2.2. KNSB provides the services subject to these Terms and Conditions through the website administered by it https://fond-knsb.com/en/
2.3. “IP address” is a unique identification number, association device, Internet page, or resource of the user, in a way that allows locating it in the global Internet network.
2.4 “Internet site” is a collection of Internet pages, with a standard header Internet page, which is loaded in your browser when typing the electronic address “https://fond-knsb.com/en/” and through which USERS are provided with the opportunity to use the information and services provided by KNSB.
2.5. A “web page” is part of a website that may be composite or stand-alone.
2.6. “Website” is the designated place in the global Internet network, accessible through its unified address (URL) under the HTTP or HTTPS protocol and containing files, programs, text, sound, pictures, images, electronic references, or other materials, and resources.
2.7. “Electronic link” is a link indicated in a particular Internet page that allows automated forwarding to another Internet page, information resource, or objects through standardized protocols.
2.8. “Information system” is a device or a system of connected devices which or any of which is designed to store, send or receive electronic documents.
2.9. “Server” is a device or system of connected devices on which, or on any of which, the system software is installed to perform tasks related to the storage, processing, reception, or transmission of information.
2.10 An “HTTP cookie” is a packet of information sent by a web server to an Internet browser, and then returned by the browser each time it accesses that server.
2.11. “Malicious actions” are actions or omissions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, including, but not limited to, sending unsolicited mail (SPAM, JUNK MAIL), channel flooding (FLOOD), gaining access to resources with foreign rights and passwords, using flaws in systems for one’s own benefit or obtaining information (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending “Trojan horses” or causing the installation of viruses or remote control systems, disrupting the normal operation of other Internet users and associated networks, as well as performing any actions that can be qualified as a crime or an administrative offense under Bulgarian legislation or under other applicable law.
2.12. “Accidental event” is an unforeseen circumstance at the time of the conclusion of the contract, which makes its implementation objectively impossible.
2.13. “User” is any person who uses any of the services and resources provided through the website.
2.14. Site “Service/s” includes:
– access to the information resources and data of the site provided through a web browser or mobile application;
2.15 “Partner” is any person with whom KNSB is in contractual relations and on whose behalf KNSB has the right to provide additional information about its goods/services to registered users of the site who have given their consent to this.
2.16. “Direct marketing” – offering information about KNSB, its publications, or products to users by traditional or e-mail, telephone, or in another direct way.

3.1. KNSB, through the Website, provides in online mode to the Users the services provided for in these Terms and Conditions, subject to strict compliance by the latter with the requirements defined in these Terms and Conditions.
3.2. The services of the Website are provided to all Users who have agreed to the current Terms and Conditions.

4.1. The user is obliged to comply with the provisions of these Terms and Conditions.
4.2. The user himself provides the client equipment necessary for the use of the provided services (end devices for accessing the Internet and relevant software applications) and access to the Internet.
4.3. The user has the right to access the Services provided through the Website in an online mode, subject to compliance with the conditions and requirements for access determined by KNSB.
4.4. The user is responsible for his actions and inactions when using the KNSB website.
4.6. The user may not reproduce, delete, change, publish or distribute in any way the information published on the site unless he has received the express consent of KNSB.
4.7. When using the services provided, the user undertakes not to upload, place on the KNSB server and not to disclose in any way to third parties user content – information, data, text, messages, as well as any other materials or electronic references to materials:
a) contrary to Bulgarian legislation, applicable foreign laws, these Terms and Conditions, Internet ethics, rules of morality, and good manners;
b) containing violence (including violence against animals), agitation for violence,
the humiliation of human dignity, a threat to the life and bodily integrity of
the person;
c) with pornographic or openly sexual content;
d) containing clearly distinguishable bodies of victims of serious accidents;
e) insulting religion or containing religious propaganda;
f) representing a trade or service secret or other confidential information;
g) which are the subject of intellectual property rights of third parties, except with the consent of the right holder;
h) promoting discrimination based on gender, race, educational qualification, age, and religion or preaching fascist, racist or other undemocratic ideology;
i) harming the good name of another and calling for a violent change of the constitutionally established order to commit a crime, to violence against the person or to incite racial, national, ethnic, or religious enmity;
j) containing information inciting or facilitating terrorist activity;
k) containing information about other people’s passwords or access rights without the consent of their holder, as well as software for accessing such passwords or rights;
4.8. The user undertakes to use the provided services:
a) not to commit malicious acts within the meaning of these Terms and Conditions;
b) to immediately notify KNSB of any case of committed or detected violation when using the provided services;
c) not to impersonate another person;
d) not to use methods leading to forced loading of content unwanted by Internet users (“pop-up”, “blind link” and the like).
4.9. The user undertakes not to carry out and not to try to gain unauthorized access to the services provided by the site by intercepting and using other people’s passwords or any other methods, not to bypass damage, or otherwise disturb the regular operation of technical or software applications on the Website that prevent or limit access to foreign electronic mailboxes, administrative panels, computer systems and networks related to the services provided.
4.10. The User undertakes to respect other Users of the site and has no right to obstruct the data from the site to other Users.
4.11. The user has the right at any time at his own discretion to terminate the use of the services provided by KNSB.

5.1. KNSB undertakes to take due care to enable the User to use the Services normally.
5.2. KNSB has the right to publish on the Internet site any textual, graphic, and other information related to its activity in the form of news, articles, or publications through textual and graphic elements, providing it for bona fide use by registered and unregistered users, depending on where is located and for which type of users it is available.
5.3. KNSB does not have the obligation and the objective opportunity to control the way in which the User uses the provided services, and is not responsible for the User’s goals and activities in connection with the use of the services.
5.4. In accordance with the requirements of the current Bulgarian legislation, the company stores information materials and resources located by the User on a server on the site, and has the right to provide them to the competent state authorities in cases where this is necessary to preserve the rights, legal interests and security of the company or to third parties, as well as in cases where the same are requested by the relevant state authorities in due order.
5.5. KNSB has the right to place on each of the pages of the Website electronic links, advertising banners, and other forms of advertising for goods and services offered by third parties, as well as electronic links and advertising banners pointing to websites located outside the control of KNSB, such as the latter is not responsible for the content, accuracy, and legality of similar Internet pages or resources and of services or resources that have become known to the User when using the services of the Website.
5.6. KNSB has the right, but not the obligation, at its discretion and without warning to suspend access to and/or remove user content when it contradicts the requirements set forth in these Terms and Conditions.
5.7. KNSB has the right to unilaterally terminate or limit without notice the access to the Internet site of a certain User, when the same distribute via the Internet, SMS, or by using services through the KNSB Internet site, messages with advertising, commercial, obscene, offensive, defamatory and/ or threatening texts and/or images, including those on a religious, religious or political basis, as well as those with pornographic content or with its actions damages the good name of KNSB, violates the laws of the Republic of Bulgaria or endangers the program and technical means through which they are provided the services.
5.8. KNSB reserves the right to temporarily or permanently suspend the provision of specific services available through the Website, without the need to notify the Users in advance.

6.1. In view of the periodic supplementation and modifications of the Service, their improvement and expansion, as well as in connection with possible legislative changes that reflect on them, the Terms and Conditions can be changed unilaterally by KNSB. This change can also be made in the event of a change in the type, nature, or technology of the Services provided, in the termination of the provision of certain Services, as well as in the event of a change in economic conditions.
6.2. When making changes to the Terms and Conditions, KNSB brings them to the attention of users by publishing them on the Internet site. KNSB gives users a two-week period to familiarize themselves with the changes in the Terms and Conditions, after which they come into effect

7.1. All materials on the Internet site are the intellectual property of KNSB or the authors indicated therein.
7.2. When using the services subject to these Terms and Conditions, the User has access to a variety of content and resources that are subject to copyright or other intellectual property rights of KNSB or the persons indicated accordingly. The USER has access to the content with a view to using it for personal needs in accordance with these Terms and Conditions and has no right to use, record, store, reproduce, change, adapt, or publicly distribute objects of intellectual property that have become available to him when using the services, except for minor information intended for personal use, provided that the legitimate interests of the authors or other holders of intellectual property rights are not unduly damaged, in the event that the copying or reproduction is carried out for non-commercial purposes, as well as in the event that the relevant content has been provided by him or received the express consent of the respective rights holders. Regardless of the above, the User has no right to remove the trademark signs and other intellectual property rights from his accessible materials, regardless of whether the holder of the relevant rights is KNSB or another User.
7.3. The intellectual property rights on all objects of intellectual property – materials, databases, and other resources located on the Website are subject to protection under the Copyright and Related Rights Act and/or the Trademarks and Geographical Indications Act, belong to KNSB or to the correspondingly specified person who transferred the right of use to KNSB and cannot be used in violation of the current legislation.

8.1. KNSB takes care to provide the User with an opportunity for normal use of the Services, but insofar as their provision is free of charge, it has no obligation and does not guarantee that they will satisfy the User’s requirements, nor that they will be continuous, timely or secure. By accepting these Terms and Conditions, the User declares that the use of the provided Services will be entirely at his own risk and responsibility, and the parties agree that the company is not responsible for any damages caused to the User when using the provided services.
8.2. KNSB is not responsible for the availability and quality of goods and the content of services brought to the attention of the User through the publication on the Website of electronic references, advertising banners, and announcements for the sale of goods and the provision of services by third parties. To the extent that the actions of these third parties are not under the control of the KNSB, the latter is not responsible for the illegal nature of the activities of the third parties or for the origination, guarantee, execution, amendment, and termination of obligations and commitments in connection with the goods offered by the third parties and services, and is not responsible for damages suffered and lost profits arising from these relations.
8.3. KNSB is not responsible for non-provision of services in the event of circumstances beyond its control – in cases of force majeure, random events, problems in the global Internet network, and in the provision of services beyond the company’s control, problems due to the User’s equipment, as well as and in case of unregulated access or intervention of third parties in the functioning of the company’s information system or servers.
8.4. KNSB shall not be liable for damages caused to the User’s software, hardware, or facilities, or for loss of data resulting from materials or resources searched, loaded, or used in any way through the Services provided.
8.5. By accepting the present Terms and Conditions, the User declares that he is aware of the possibility of possible interruptions and other types of difficulties when establishing the Internet connection to the Website, which may arise regardless of the care taken by KNSB. The user declares that he will not claim any compensation from KNSB for lost profits, suffered damages, or inconveniences due to the occurrence of the above-mentioned interruptions or difficulties in the Internet connection, including in relation to the capacity of this connection.
8.6. KNSB is not responsible and does not owe compensation to a person whose personal data was used by another person for the use of the Services provided by the company, regardless of whether or not he gave consent for this.
8.7. The user is responsible for all damages caused to KNSB as a result of incomplete, inaccurate, false, or fraudulent information provided by him.
8.8. By using the Internet site “https://fond-knsb.com/en” the User is responsible for all wrongful consequences arising from this use. The user is responsible for any pecuniary, non-pecuniary, or damages of any other nature caused to the Internet site “https://fond-knsb.com/en” in relation to its content or the services provided through it, to KNSB

9.1. KNSB has the right to collect and use information about users. The information by which the person can be identified may include first name, last name, last name, e-mail, as well as any other information that the User voluntarily enters, uses or provides when using the service on the Internet site.
91.2. KNSB takes due care for the collection, processing and storage of the personal data of the Users, in strict compliance with the provisions of the Personal Data Protection Act.
9.3. KNSB takes due care and is responsible for protecting the information about the Users, which became known to it on the occasion of providing the service, subject to these Terms and Conditions, except in cases of force majeure, accidental event or malicious actions of third parties, as well as in cases, where the Users themselves have made this information available to third parties.
9.5. KNSB collects and uses the information for the purposes provided for in these Terms and Conditions, including for offering new services to Users, for promotions, inquiries, for statistical and any other purposes, as by using the Service, the User agrees to receive messages sent by KNSB. The described purposes for which the information may be used are not exhaustively listed and do not create any obligations for KNSB.
9.6. By accepting these Terms and Conditions, the User agrees to the processing of his personal data for direct marketing purposes. The user has the right to object to the processing of his personal data for the purposes of direct marketing by sending a written message to KNSB at the specified address.
9.7. KNSB undertakes not to edit or disclose the personal data it has become aware of about the User or the Service used by him and not to provide the collected information to third parties – state bodies, commercial companies, individuals and others, except in cases where:
A) this is provided for in these Terms and Conditions or the User has given his express consent during registration or at a later time;
B) this is necessary for the fulfillment of a legally established obligation of KNSB;
C) the information is requested by state bodies or officials who, according to the current legislation, are authorized to request and collect such information in compliance with the legally established procedures;
D) information regarding personal data is provided to employees or subcontractors of KNSB for activities related to the administration of the same and the use of the Service;
E) other cases specified in the law.
9.8. When using the Website, KNSB has the right to automatically save certain information that the User’s computer or other terminal device sends to the site’s server and/or KNSB in connection with the User’s activity. The information is stored on KNSB servers and may include the User’s IP address, date and time when the relevant page of the Website was visited, the time spent on it, etc. In addition, KNSB stores the User’s IP address, as well as any other information necessary to identify the User and reproduce his electronic statement 1 of acceptance of the Terms and Conditions, in the event of a legal dispute.

10.1. KNSB has the right, but not the obligation, to install on the User’s computer or other end device cookies (cookies) – small text files that are saved from an Internet page through an Internet server on the User’s hard disk and enable the recovery of information about The user, identifying him and tracking his actions.
10.2. KNSB uses so-called “Cookies” and similar techniques for processing consumption data on its website, in our capacity as a personal data administrator.
10.3. “Cookies” are text computer data/codes stored in the User’s browser, intended for use by web pages. This data allows the identification of the User’s device and the correct behavior of a given website according to his individual preferences. “Cookies” usually contain the name of the website, the storage time of the end device, and a unique number.
10.4. Cookies are small text files that are stored on the User’s end device (laptop, tablet, smartphone, etc.) when the User visits the KNSB website. Cookies do not cause any damage to the User’s end device and do not contain viruses, “Trojan horses” or other malicious software. The information is stored in the cookie, which leads to a connection with the specific device used. However, this does not mean that KNSB immediately knows about the identity of the User.
10.5. “Cookies” are used to adapt the content of the page to the User’s preferences and to optimize the use of the website. They are also used to create anonymous statistics (about the User’s behavior on the site) in order to improve the structure and content of the site.
10.6. Personal data collected by cookies can only be used to implement specific website functions. Personal data is encrypted to prevent access by unauthorized persons

These settings can be changed in such a way as to block the automatic management of cookies in the browser or to inform the browser whenever a cookie, is attached to the User’s device. 10.8. Limiting the use of cookies may affect some of the functionalities that the website provides to the User.

11.1. KNSB is the controller of personal data according to the Personal Data Protection Act. In connection with the use of the services of the sites and applications, we process personal data under the terms of our Privacy Policy.
11.2. KNSB collects statistical information and prepares internal statistics on website traffic and its users solely for the development of the publication and its content. Data for statistical purposes are anonymized and not provided to third parties.
11.3. The data is used for Direct Marketing purposes only if you have expressly given your consent to this.
11.4. It is not considered direct marketing to send information about changes to the registration conditions, the Terms of Use of the sites and applications, the Privacy Policy or other messages related to the use of the site.
11.5. If the KNSB web page contains references to third-party pages, the respective foreign operators are responsible for their content.

12.1. These Terms and Conditions are subject to the norms of the current Bulgarian legislation.
12.2. The parties agree that in the event that any of the clauses under these Terms and Conditions turns out to be invalid, this will not invalidate the contract, other clauses or its parts. The invalid clause will be superseded by the mandatory rules of law or established practice.
12.3. All disputes between the parties arising out of or in connection with the use of the Internet site shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes arising out of or relating to the contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, and disputes to fill gaps in the contract or its adaptation to new circumstances, will be resolved by the competent court under current Bulgarian legislation.
12.4. Written or electronic statements and communications provided for in the contract and these Terms and Conditions shall be considered validly made if they are made in the form of a letter with return receipt, facsimile message, e-mail, pressing a virtual button on the Website and the like, insofar as the statement is recorded technically in a way that enables it to be reproduced.
12.5. By accepting these Terms and Conditions and concluding a contract with each other, the parties express their agreement to consider the electronic statements made between them as received upon their entry into the information system indicated by the addressee, without the need for explicit confirmation. In the event that the User has specified an invalid e-mail address, the statement will be considered received only when it is sent by the company, even if it has not been received.
12.6. These Terms and Conditions may be amended and/or supplemented in the order in which they were adopted, or for each specific case with special conditions.
12.7. The amended or newly adopted Terms and Conditions are published on the Internet site and enter into force immediately.
12.8. The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not settled under these Terms and Conditions.
